Entertainment giant Disney has launched a $10 million trademark lawsuit against the NHL, asking courts to award it punitive damages and impose an injunction against the hockey organization over its use of the “Stanley” Cup. According to the lawsuit, “the defendant knowingly and spitefully continues to use the offending word in its designation of the trophy, which clearly co-opts our trademarked Marvel name ‘Stan Lee’. We ask the court to order the NHL to cease and desist immediately, and also order reparations of $5 million and further punitive damages of $5 million, to deter them from any further gregarious conduct.”
In response, NHL lawyers came out with sticks swinging, countering that “it is a well know fact that this trophy was commissioned in 1892 by Lord Stanley, which predates any claim Marvel may even remotely have. Furthermore, wtf, it’s not even spelled the same!”
Disney was quick to rebutt the league’s argument, posting on Twitter that “that’s bullshit! – everyone knows Stan Lee is older than dinosaurs, and who gives a shit how it’s spelled – it’s the same thing no matter how you say it. Potaato, potahto, pfffft.”
The suit is expected to start discovery phase in March, once Mickey Mouse returns from a 2 week drunk tank in Bangkok.
